Terms of Service

These Terms govern your use of the AiAppraisal website and valuation reports operated by Aiappraisal, LLC ("we", "us"). By creating an account or purchasing a report, you agree to them. Please read section 3 carefully — it describes what our reports are not.

1. What we provide

We provide automated residential property valuation reports. Each report applies a sales comparison methodology to public property records, comparable sales data licensed from third-party providers, and photographs and property information that you supply. The output is an estimate of market value together with a supported range, a confidence level, and the underlying analysis.

2. Eligibility and your account

You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of the information in your account and for keeping your password confidential. You are responsible for all activity that occurs under your account.

3. What our reports are not

This section is important. Our reports are automated valuation products. They are not:

• Not appraisals. Our reports are not appraisals as that term is defined under the Uniform Standards of Professional Appraisal Practice (USPAP) or under applicable state appraisal law. They are not prepared, reviewed, signed, or certified by a state-licensed or state-certified real property appraiser.
• Not acceptable for mortgage lending. Our reports may not be used, and will not be accepted, as the basis for originating, underwriting, purchasing, or securitizing a mortgage loan or any other federally related transaction.
• Not based on an inspection. No representative of ours inspects the property. We do not observe the interior, the structure, the systems, or the grounds, and we express no opinion on the property's physical condition, habitability, safety, code compliance, or the presence of defects or hazardous materials.
• Not professional advice. Our reports do not constitute legal, tax, accounting, investment, or real estate brokerage advice. Consult an appropriately licensed professional before acting.

4. Accuracy and inherent limitations

Valuation is an estimate, not a fact. Our reports depend on the availability and accuracy of third-party data and on the completeness and truthfulness of the information and photographs you provide. Public records are frequently incomplete or wrong. Comparable sales may be scarce or dissimilar, particularly for rural, unique, historic, or high-value properties and in markets with few recent transactions.

Actual sale prices routinely differ from any estimate, including ours. We make no representation or warranty that a report reflects the price at which a property could actually be sold. Where our analysis is less well supported, the report discloses this through a wider value range and a lower stated confidence level, and you should weigh it accordingly.

5. Your responsibilities regarding submitted content

You represent that you have the right to submit every photograph and item of information you upload, and that doing so does not infringe any third party's intellectual property, privacy, or other rights. You must not obtain photographs by trespassing or by any other unlawful means. You must not upload content that is unlawful, or that contains other people's personal information without a lawful basis.

You grant us a limited license to store, process, and analyze the content you submit for the purpose of producing your report and operating and improving the service. You retain ownership of your content.

6. Ordering, pricing, and payment

The price of each report is shown at checkout before you pay. Payment is processed by Stripe; we do not receive or store your full card details. Prices may change, but the price shown at checkout is the price you pay for that order. You are responsible for any applicable taxes.

7. Delivery

We aim to deliver each report within hours of receiving your completed property details and photographs. This is a target, not a guarantee. Incomplete submissions, data provider outages, and properties requiring additional analysis may take longer. If we cannot deliver, our refund policy applies.

8. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

9. Permitted use of reports

Your report is licensed to you for your own use and for sharing with your own advisers and counterparties in connection with the property it concerns. You may not resell reports, redistribute them commercially, present them as your own work, remove or alter their disclosures and limiting conditions, or represent them as appraisals.

You may not scrape the site, attempt to access accounts or data that are not yours, reverse engineer the service, or use automated means to place orders.

10. Intellectual property

The site, the software, the report format, and the underlying methodology are owned by us and protected by intellectual property law. Third-party property data remains subject to the rights of its providers.

11. Disclaimer of warranties

The service and the reports are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service will be uninterrupted or error free, or that any estimate will prove accurate.

12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost opportunities, or losses arising from any decision to buy, sell, hold, price, finance, insure, or litigate over a property, whether or not we were advised of the possibility of such damages.

Our total aggregate liability arising out of or relating to the service or any report will not exceed the amount you actually paid us for the report giving rise to the claim.

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. Nothing in these Terms excludes liability that cannot lawfully be excluded.

13. Indemnification

You agree to indemnify and hold us harmless from claims, damages, and reasonable costs arising from your breach of these Terms, your misuse of a report, or content you submitted that you did not have the right to submit.

14. Suspension and termination

We may suspend or terminate an account that breaches these Terms, that we reasonably believe is being used unlawfully or fraudulently, or that is abusing the service. You may close your account at any time by contacting us.

15. Changes to these Terms

We may update these Terms. Material changes will be reflected in the "last updated" date above, and continued use after a change constitutes acceptance. The Terms in force when you placed an order govern that order.

16. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws rules. You and we agree to try in good faith to resolve any dispute informally before commencing proceedings.
